Creativity and creative works are inseparable. Copyright is both positive as well as negative right. It facilitates further creations by the society in one hand and prevents others to use of creative works beyond a certain level in the other. World Social Science Report 2016 published by the United Nations clearly emphasised about prevalence of knowledge inequality in our society. This inequality is inevitable if we do not practise fair use of our knowledge. Even in the recent landmark judgement in September 2016, Delhi High Court also attested and upheld that view.

This book identified the genesis and provisions of fair use in the Indian Copyright Act, 1957 with an international flavour. Fair use has always been considered as a grey area by legal pundits but this title has demonstrated that it can alsoact as an opportunity administering a safety valve to bring balance in the quest of interpretive certainty needed for the society for further advancement of knowledge over the existing ones. It goes on to deeper understanding of fair use with a How-To-Determine format to keep one in the right side of the law and analyse a plethora of national and international case studies. Academic community in a number of universities has been studied investigating their awareness regarding fair use of copyrighted resources and discovered a disturbing trend. This volume scripted a copyright management policy for universities which is at present completely missing in India. Science from the University of Calcutta and Associateship in Information Science (AIS) from NISCAIR, CSIR with specialization in Patent Information System. He has been teaching IPR and related issues in the Department of Library & Information Science of the University of Calcutta as Senior Assistant Professor for several years. He is best known for his teaching technique and as dedicated researcher on IPR particularly patent and copyright for more than a decade. Dr.Chaudhuri is frequent lecturer in the UGC-Human Resource Development Centres of several universities on IPR issues. His first research article on IPR was appeared way back 2003in the Journal of Intellectual Property Rights (JIPR). After that he has written numerous research articles, book chapters published in national and international journals on IPR. His first bookIntellectual Property Rights, Biodiversity and Information System: From Basics to Challenges Ahead published internationally from Germany in 2011.Dr.Chaudhuri was also the Principal investigator of the UGC Research Project on Fair Use and Copyright. He completed courses on IPR from different world renowned institutes and universities including CopyrightX, most prestigious programme internationally on copyright from the Berkman Center for Internet & Society in the Faculty of Law at Harvard University, US and IP Procedure from Rajiv Gandhi National Institute of Intellectual Property Management (RGNIIPM), Govt. of India, Nagpur in 2016, courses on Copyright from Duke University & The University of Rhode Island, US in 2014with distinction and course on IPR from the WIPO Academy, Geneva in 2009.Author can be met on http://www.sabujkc.webs.com
